Terms of Use
1. Purpose
These Terms of Use (the "Terms") govern access to and use of the Notepan service (hereinafter "Notepan" or the "Service"), a platform that enables the creation, editing, sharing, viewing, and export of tablatures for handpan and similar instruments.
Any use of the Service constitutes full acceptance of these Terms.
Use of the Service is also subject to the Privacy Policy, the End User License Agreement (EULA), and where applicable, the Terms of Sale. These documents form an integral part of the contractual relationship between the user and Notepan.
2. Service Operator
The Notepan Service is operated by Maxence Champy EI, a sole proprietor established in France.
Full legal information regarding the Service operator is available in the Legal Notice section of the Service.
3. Access to the Service
Access to certain features requires the creation of a user account.
Users agree to provide accurate, complete, and up-to-date information when registering and to keep such information updated throughout their use of the Service.
Minors must obtain authorization from their parent or legal guardian before using the Service.
Users are solely responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.
4. Description of the Service
Notepan provides, among other things:
- tablature editing
- tablature viewing
- sharing tablatures with the community
- exporting tablatures as PDF files
- a community tablature library
- free and Premium features
Notepan reserves the right to modify, suspend, or discontinue all or part of the Service at any time in order to improve or adapt it.
5. User Content
Users may submit tablatures to the Notepan community library. Submissions may be subject to moderation before publication.
Users remain solely responsible for the content they publish. Users represent and warrant that they possess all rights, permissions, and licenses required to publish any content submitted to the Service.
The publication of content that is:
- unlawful
- fraudulent
- defamatory
- infringing upon third-party rights
- containing malicious software or harmful code
- contrary to applicable laws or regulations
is prohibited.
Notepan is not obligated to verify the accuracy, originality, or legality of content submitted by users prior to publication. Approval or publication of content by Notepan does not constitute any guarantee of its legal compliance.
6. Attribution
When a tablature is published, the username associated with the user's account may be displayed publicly in order to identify the author.
The user accepts such attribution as part of the normal operation of the Service.
7. License Granted to Notepan
Users retain full ownership of all intellectual property rights relating to the tablatures they publish.
In order to operate the Service, users grant Notepan a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to:
- host content
- store content
- reproduce content
- display content
- index content
- distribute content within the Service
- make technical adaptations necessary for the operation of the platform
- enable PDF exports
- include content in rankings, recommendations, and editorial selections
This license remains valid for as long as the content remains available on Notepan.
8. Promotional Use of Content
Users authorize Notepan to display, promote, reference, feature, and recommend published tablatures as part of the operation and promotion of the Service.
Such use may include, but is not limited to, editorial selections, rankings, recommendations, screenshots, demonstration videos, social media posts, or any other communication materials related to Notepan.
Users may request at any time that their tablatures no longer be used for external promotional purposes. Notepan will make reasonable efforts to cease any future promotional use of the relevant content within a reasonable timeframe.
Such requests do not affect promotional uses that occurred prior to receipt of the request.
9. Copyrighted Content
Notepan operates as a hosting platform for content submitted by its users.
Users remain solely responsible for ensuring that the content they publish complies with applicable intellectual property laws.
Upon receiving a notice alleging copyright infringement or any other intellectual property violation, Notepan reserves the right to remove the relevant content without prior notice.
Any person who believes that content available through the Service infringes their rights may contact Notepan to request a review and, where appropriate, removal of the content.
10. Moderation
Notepan reserves the right, at its sole discretion and without obligation to provide justification, to:
- reject submissions
- modify the visibility of content
- remove published content
- suspend or terminate user accounts
Such measures may be taken in particular in cases involving violations of these Terms, disputed content, or behavior that negatively impacts the operation of the Service.
11. Commercial Use
Users remain free to commercially exploit their own original creations and tablatures, provided they respect the rights of third parties.
Unless expressly authorized by the relevant rights holder:
- tablatures published by other users may not be resold or commercially redistributed
- official Notepan content may not be commercially exploited
- users may not create or supply competing services using content available through Notepan.
Specific commercial uses may be subject to separate agreements with Notepan.
12. Free Features, Free Trial, and Premium Plans
Certain features of the Service are available free of charge.
Other features are reserved for users who subscribe to a Premium plan, purchase Lifetime Access, or benefit from a free trial period when offered.
Pricing, free trial eligibility, billing, renewal, and cancellation terms are detailed in the Terms of Sale.
Lifetime Access provides access without a predefined time limit for as long as the Service continues to be operated by Notepan.
13. PDF Exports
The Service may allow users to export tablatures as PDF files.
Users remain responsible for complying with applicable intellectual property laws when using, sharing, or distributing exported files.
14. Account Deletion
Users may request deletion of their account at any time.
Deleting an account does not automatically remove previously published tablatures.
Before deleting their account, users may remove their own content.
Following account deletion, users may also contact Notepan to request the removal of their tablatures.
Unless otherwise requested, published content may remain available in order to preserve the integrity of the community library.
15. Suspension and Termination
Users may suspend or terminate an account without prior notice in cases including, but not limited to:
- violation of these Terms
- fraud
- attempts to circumvent Service limitations
- actions compromising the security of the Service
- publication of unlawful content
- behavior detrimental to the Service or its users
16. Intellectual Property of Notepan
The Service, including its software, source code, graphical elements, interfaces, logos, trademarks, icons, sounds, official content, and all other components of Notepan, is protected by applicable intellectual property laws.
No ownership rights or licenses are granted to users other than those strictly necessary to use the Service.
Any unauthorized reproduction, distribution, extraction, modification, or exploitation is prohibited.
17. Service Availability
Notepan strives to maintain the availability of the Service but does not guarantee any minimum level of uptime.
The Service may be temporarily interrupted for maintenance, updates, technical improvements, or any other reason necessary for its operation.
18. Limitation of Liability
The Service is provided on an "as is" basis.
To the fullest extent permitted by law, Notepan shall not be liable for:
- content published by users
- loss of data
- Service interruptions
- errors or omissions in content
- indirect damages resulting from use of the Service
Users acknowledge that they use the Service at their own risk.
19. Changes to the Terms
Notepan may modify these Terms at any time. Updated versions become effective upon publication through the Service.
In the event of significant changes, Notepan may notify users through appropriate means.
20. Governing Law and Disputes
These Terms are governed by French law.
Any dispute relating to the interpretation, validity, or performance of these Terms shall be subject to the jurisdiction of the competent French courts, without prejudice to any mandatory legal provisions that may apply.

Terms of Sale
1. Purpose
These Terms of Sale (the "Terms") govern the purchase and use of paid offerings provided by Notepan.
Any purchase of a paid offering constitutes full acceptance of these Terms, as well as the Notepan Terms of Use.
2. Service Operator
The Notepan Service is operated by the entity identified in the Legal Notice section of the Service.
3. Available Plans
Notepan currently offers the following plans:
- Free Plan
- Monthly Premium Plan
- Annual Premium Plan
- Lifetime Access
The features included in each plan are described on the Notepan website at the time of purchase.
Notepan reserves the right to modify the features included in its plans in order to improve and evolve the Service.
4. Free Trial
Notepan may offer a free trial period allowing temporary access to Premium features.
Unless otherwise stated, the free trial lasts thirty (30) days.
No payment method is required to access the free trial.
At the end of the trial period, the account automatically reverts to the Free Plan unless the user voluntarily subscribes to a paid plan.
To prevent abuse, Notepan reserves the right to restrict access to free trials and to implement reasonable measures designed to detect repeated or fraudulent use of trial offers.
5. Pricing
All prices are displayed in euros (€).
Unless otherwise stated, displayed prices include applicable VAT where required.
The applicable price is the price displayed at the time of purchase.
6. Payment
Payments are processed by Stripe, an independent payment provider.
Notepan does not store users' complete payment card information.
Payment is due immediately upon purchase.
All transactions are subject to Stripe's applicable terms and conditions.
7. Subscription Renewal
Monthly and annual subscriptions renew automatically at the end of each billing period.
Users may cancel their subscription at any time through their account management interface or through the methods made available by Notepan.
Upon cancellation, access to Premium features remains active until the end of the already paid subscription period.
No further renewal charges will be applied after cancellation has been processed.
8. Price Protection
Users with an active subscription retain the price that was in effect when they originally subscribed.
Any future price increase will apply only to new subscriptions or to users who voluntarily switch to a different plan.
9. Lifetime Access
Lifetime Access is a one-time purchase that grants access to Premium features without a predefined expiration date for as long as the Service continues to be operated by Notepan.
Lifetime Access provides access to Premium features for the duration of the Service's operation by Notepan. It does not constitute a guarantee that the Service will remain available indefinitely.
Notepan reserves the right to modify and evolve the Service over time.
Lifetime Access includes access to future updates, improvements, and new features made available as part of the Premium offering, for as long as the Service continues to be operated by Notepan.
10. Right of Withdrawal
Consumers may benefit from a statutory right of withdrawal for certain distance purchases, subject to applicable laws.
However, by purchasing a paid plan and requesting immediate access to Notepan's digital services, the user acknowledges that performance of the service begins immediately.
To the extent permitted by applicable law, the user agrees that immediate access to digital content and services may result in the loss of the statutory right of withdrawal.
11. Refunds
Refund requests may be reviewed on a case-by-case basis at Notepan's sole discretion.
The approval or denial of a refund request remains subject to Notepan's assessment, without prejudice to any mandatory consumer rights provided by applicable law.
Any approved refund will be issued through the original payment method whenever possible.
12. Permitted Use
Notepan plans may be used for personal or professional purposes, provided that users comply with these Terms, the Terms of Use, and applicable intellectual property laws.
Purchasing a paid plan does not grant ownership rights to the software, official Notepan content, or content published by other users.
13. Suspension or Termination
Notepan may suspend or terminate access to a paid plan in the event of:
- Fraud
- Attempts to circumvent Service limitations
- Violation of the Terms of Use or these Terms of Sale
- Abuse of the Service
Such actions do not automatically entitle the user to a refund.
14. Service Availability
Notepan strives to maintain the availability of the Service but does not guarantee any minimum uptime or service level.
Temporary interruptions may occur for maintenance, security, technical improvements, or other operational reasons.
Such interruptions do not automatically entitle users to compensation or refunds.
15. Limitation of Liability
To the fullest extent permitted by law, Notepan shall not be liable for indirect damages arising from the use of, or inability to use, the Service.
Notepan's total liability relating to a paid plan shall not exceed the amount paid by the user during the twelve (12) months preceding the event giving rise to the claim.
16. Changes to the Terms
Notepan may modify these Terms at any time.
Updated versions will be published on the Notepan website and become effective upon publication.
17. Governing Law and Disputes
These Terms are governed by French law.
Any dispute relating to the interpretation, validity, or performance of these Terms shall be subject to the jurisdiction of the competent French courts, without prejudice to any mandatory consumer protection laws that may apply.

End User License Agreement
1. Purpose
This End User License Agreement (the "Agreement" or "EULA") sets forth the terms under which Notepan grants the user a limited license to use the Notepan Software.
For the purposes of this Agreement, the term "Software" refers to the Notepan application and any future versions distributed for desktop computers, mobile phones, tablets, or any other supported platform.
By downloading, installing, accessing, or using the Software, the user agrees to be bound by this Agreement.
If the user does not agree to these terms, they must not install or use the Software.
This EULA supplements the Notepan Terms of Use, Terms of Sale, and Privacy Policy.
2. License Grant
Subject to compliance with this Agreement, Notepan grants the user a license that is:
- Limited
- Non-exclusive
- Non-transferable
- Non-sublicensable
- Revocable
allowing the user to install and use the Software for personal or professional purposes.
The user may use the Software on multiple devices that they own or control, subject to the conditions applicable to their Notepan account.
No ownership rights in the Software are transferred to the user.
3. Intellectual Property
The Notepan Software is protected by intellectual property laws.
Unless otherwise stated, Notepan remains the exclusive owner of all rights relating to, including but not limited to:
- The Software and its source code
- Compiled code and executable files
- The user interface
- The design and user experience
- The Notepan name
- Logos and branding elements
- Icons, illustrations, and graphical assets
- Associated documentation
- Audio samples, sounds, and other multimedia assets included in the Software
- Any updates, improvements, or evolutions of the Software
Nothing in this Agreement shall be interpreted as transferring any intellectual property rights to the user.
4. Restrictions
Unless expressly authorized in writing by Notepan or required by applicable law, the user agrees not to:
- Copy, reproduce, or redistribute the Software
- Sell, rent, lease, or otherwise make the Software available to third parties
- Modify, adapt, or alter the Software
- Create derivative works based on the Software
- Circumvent security or protection mechanisms implemented in the Software
- Remove or obscure intellectual property notices
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software
- Attempt to access non-public technical information relating to the Software
- Use bots, automated scripts, scraping tools, or other automated means to extract data from the Software or Notepan services
- Interfere with or attempt to interfere with the operation of the Software or related services
- Use the Software in any manner that infringes the rights of Notepan or third parties
5. Artificial Intelligence and Machine Learning Restrictions
Unless expressly authorized in writing by Notepan, the user may not use any part of:
- The Software
- Official Notepan content
- Graphical assets
- Audio samples
- Documentation
- Data extracted from the Service through automated means
for the purpose of training, developing, improving, or operating artificial intelligence models, machine learning systems, or similar technologies.
6. Online and Offline Features
Certain features of the Software require an active Internet connection, including:
- User authentication
- Account management
- Access to the online community library
- Features relying on services hosted by Notepan
Other features, such as tablature editing and playback, may remain available offline depending on the capabilities of the version being used.
Notepan does not guarantee continuous availability of online features.
7. Updates
Notepan may automatically deploy updates, patches, security fixes, and new features when the Software starts.
Continued use of the Software may require the installation of such updates.
The user acknowledges that older versions of the Software may become unsupported or incompatible with certain Notepan services or features.
8. Third-Party Software
The Software may incorporate or rely upon third-party software, libraries, or components.
Such components may be subject to their own licenses and terms.
The rights granted under this Agreement do not replace or modify any obligations arising from applicable third-party licenses.
9. Termination
The license granted under this Agreement remains valid as long as the user complies with its terms.
If the user violates this Agreement, the Terms of Use, or any other terms applicable to the Service, Notepan may immediately suspend or terminate the license granted to the user.
Upon termination:
- All rights granted under this Agreement immediately cease
- The user must stop using the Software
- Certain account-related features may become unavailable
Termination does not affect any rights or obligations that arose before termination.
10. Disclaimer of Warranty
The Software is provided "as is" and "as available."
To the fullest extent permitted by law, Notepan does not warrant that:
- The Software will be error-free or uninterrupted
- The Software will meet all of the user's specific requirements
- Features will be available at all times
- Defects will be corrected within any specific timeframe
The user uses the Software at their own risk.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Notepan shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of, or inability to use, the Software.
Notepan's total liability, regardless of the cause of action, shall not exceed the amounts actually paid by the user to Notepan during the twelve (12) months preceding the event giving rise to the claim.
12. Changes to this Agreement
Notepan may modify this EULA at any time to reflect changes to the Software, the Service, or applicable legal requirements.
The most current version of the Agreement is available on the Notepan website.
Continued use of the Software after changes become effective constitutes acceptance of the updated Agreement.
13. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of France.
Any dispute relating to the interpretation, validity, or performance of this Agreement shall be subject to the jurisdiction of the competent French courts, without prejudice to any mandatory consumer protection rights under applicable law.

Privacy Policy
1. Introduction
This Privacy Policy explains what data is collected by Notepan, why it is collected, and how it is used.
Notepan is committed to protecting the privacy of its users and processing personal data in accordance with the General Data Protection Regulation (GDPR) and applicable French law.
2. Data Controller
The data controller is the operator of the Notepan service, whose full contact details are available in the Legal Notice.
3. Data We Collect
Account Information
When creating and using an account, Notepan collects:
- Email address
- Name or username
- Password (stored in a hashed and unreadable format)
- Account creation date
Session and Device Information
When using the application, Notepan may record:
- Operating system
- Device identifier (a GUID generated locally by the application)
- Information required to manage user sessions
This identifier is used solely for technical and security purposes and does not by itself allow direct identification of an individual.
Free Trial Information
To prevent abuse of free trial offers, Notepan may retain:
- An irreversible hash of email addresses that have already benefited from a free trial
- Certain anonymized technical identifiers used to detect repeated use of free trials
This information is used exclusively to prevent fraud and circumvention of Service limitations.
Error Reports and Diagnostics
To improve the stability, performance, and quality of the application, Notepan automatically collects certain technical information when an error or malfunction occurs.
This information may include:
- The error or exception type
- The error message
- The stack trace
- Technical details of the exception
- The operating system involved
This information is transmitted to Backtrace, a service provider used by Notepan for the collection and analysis of error reports.
It is not intended to personally identify users and is used solely for diagnostic, maintenance, and Service reliability improvement purposes.
4. Purposes of Processing
The collected data is used to:
- Create and manage user accounts
- Authenticate users
- Provide Service functionality
- Maintain Service security
- Prevent abuse and fraud
- Manage subscriptions and payments
- Send Service-related communications
- Diagnose and fix software issues
- Improve the stability and reliability of the application
Notepan does not use behavioral analytics, usage tracking, or audience measurement tools.
5. Service Providers and Processors
To operate the Service, certain data may be processed by technical service providers acting on behalf of Notepan, including:
- Microsoft Azure for application hosting, website hosting, database hosting, and file storage
- Stripe for payment and subscription processing
- Plunk for email delivery
- PromoteKit for affiliate program management
- Backtrace for the collection and analysis of application crash and error reports
These providers only access data to the extent necessary to perform their respective services.
The privacy policies of these service providers are available on their respective websites.
6. Data Hosting
The core Notepan services, including the website, API, database, and file storage, are hosted on Microsoft Azure infrastructure located in France.
Certain services, including payment processing, email delivery, affiliate program management, and error report analysis, are provided by third-party service providers that may process certain data outside France or the European Union in accordance with applicable legal safeguards and their contractual obligations.
7. Cookies
Notepan uses a limited number of cookies that are strictly necessary for the operation of the Service.
Authentication Cookie
When a user signs in to their account, an authentication cookie may be created to maintain the user's session and allow access to secured features of the Service.
This cookie is essential to the operation of user accounts.
Affiliate Cookie
Notepan also uses a cookie provided by PromoteKit to correctly attribute sales generated through the affiliate program.
This cookie is used solely to identify the affiliate responsible for a referral and is not used for behavioral analytics or targeted advertising.
No Analytics Tools
Notepan does not use Google Analytics, Mixpanel, Microsoft Clarity, Firebase Analytics, or any other analytics or user activity tracking platform.
8. Data Retention
Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected.
If an account is deleted:
- Account data is deleted
- Associated sessions are deleted
- Information directly linked to the account is deleted
Certain anonymized or pseudonymized technical information may be retained where necessary for fraud prevention, Service security, or compliance with legal obligations.
Payment-related information is managed and retained by Stripe in accordance with its own legal and regulatory obligations.
9. Email Communications
Notepan may send emails relating to the operation of the Service, including:
- Email address verification
- Password reset requests
- Account-related information
- Invoices, receipts, and payment confirmations
- Service announcements
- Occasional newsletters
- Promotional offers
Every marketing email includes a mechanism allowing users to unsubscribe from future promotional communications.
10. Security
Notepan implements reasonable technical and organizational measures designed to protect data against unauthorized access, loss, alteration, or disclosure.
However, no computer system can guarantee absolute security.
11. Your Rights
Subject to applicable law, users have the following rights:
- Right of access
- Right to rectification
- Right to erasure
- Right to restriction of processing
- Right to object
- Right to data portability where applicable

Users also have the right to lodge a complaint with the French Data Protection Authority (CNIL) or any other competent data protection authority.
12. Changes to this Privacy Policy
Notepan may update this Privacy Policy at any time to reflect changes to the Service or applicable legal requirements.
The most recent version is always available on the Notepan website.
